The Nicaraguan Parliament has approved the Creation of the Nicaraguan Red Cross Law as an autonomous and decentralized entity attached to the country’s Ministry of Health (Minsa).
In this regard, the Legislative Power has announced the approval of Law No. 1152, Law on the Repeal of Legislative Decree No. 357 of 1958 and the Creation of the Nicaraguan Red Cross, published in La Gaceta, Official Diary.
Regarding the repeal, it is argued that the Nicaraguan Red Cross association has failed to comply with the essential principles of the international Red Cross and Red Crescent movement, «including humanity, impartiality, and neutrality.»
In this regard, it is detailed that «in the events that occurred in 2018 that threatened the peace and stability of the nation, some branches of this association acted against these principles and its articles of incorporation and bylaws, and the association itself violated the laws of the country by disregarding and even supporting this behavior of its branches.»
Nicaraguan Red Cross as an autonomous entity
The new law mandates in Article 2: «The Nicaraguan Red Cross is created as an autonomous, decentralized entity, with legal personality, its own assets, indefinite duration, and full capacity to acquire rights and obligations, which will be the legal successor without interruption of the association called the Nicaraguan Red Cross, created by legislative decree number 357 published in the Gazette, No. 248 of October 29, 1958.»

Likewise, in its section on Transfer and Registration of Assets, it establishes that «all the assets, properties, and actions that belong to the association called the Nicaraguan Red Cross as of the date will become the property of the State and will be managed by the Nicaraguan Red Cross as a decentralized entity attached to the Ministry of Health, MINSA.»

The Nicaraguan Legislative Assembly highlighted with this law that it will also be «guaranteeing the job stability and operation of the institution, with full capacity to acquire rights and obligations.»
